How Bail Works

Understanding the bail process can feel overwhelming — especially in the middle of a crisis. Here's what you need to know, step by step. CAUTION!!!  Recent Bail Scams are affecting Johnson County. Noone from the jail or Sheriff's Office will ever call you asking for bond payment or a "monitoring fee" for an inmate.    Nor will a licensed bondsman ever ask you to just send money electronically without meeting with you in person.   If this happens, hang up immediately and call us.   The jail can also provide you with a list of licensed bail companies.

The Bail Process, Step by Step

01

Arrest & Booking

After an arrest, the person is taken to a local jail or detention facility for booking. This includes recording personal information, taking fingerprints, and logging the charges. Booking typically takes 2–6 hours.

02

Bail Is Set

A judge sets the bail amount at an arraignment or first appearance — sometimes within hours, sometimes the next business day. The amount depends on the charges, criminal history, and flight risk. In Johnson County, common bail amounts range from a few hundred to tens of thousands of dollars.

03

Call Heartland Bail Bonds

Once bail is set, call us at 913.327.9033. We're available 24 hours a day, 7 days a week. We'll gather basic information about the defendant and the charges, explain your options, and get started immediately.

04

Sign the Bond Agreement

You'll pay a non-refundable premium — typically 10% of the total bail amount, as set by Kansas law. We'll walk you through the paperwork, which can often be completed over the phone or electronically. Collateral may be required for larger bonds.

05

We Post the Bond

Once the paperwork is signed and the premium is paid, we post the bond with the jail or court. This guarantees the defendant will appear at all required court dates.

06

Release & Court Dates

The defendant is released — often within 1–4 hours of the bond being posted. It's critical that they appear at every scheduled court date. Missing a court date can result in the bond being forfeited and a warrant issued for re-arrest.

What Does a Bail Bond Cost?

In Kansas, bail bond premiums are regulated by state law at 10% of the total bail amount. This fee is non-refundable — it's the cost of the bail bond service. For example, if bail is set at $10,000, the premium is $1,000. We accept multiple forms of payment and can discuss payment plans for qualifying situations.
